My apartment complex, with around 35 one-bedroom flats and 5 two-bedroom ones, has always allowed residents and tenants to park their vehicles freely. However, the society committee is now proposing a rule barring tenants from parking on the premises. Is this restriction legally permissible?
The society committee's proposal to restrict tenants from parking on the premises may not be legally permissible. In India, a tenant generally has the right to park their vehicle on the common area of the apartment complex, subject to reasonable restrictions imposed by the society. The right is subject to existing agreements and bye-laws of the society.
