What Is The Hindu Succession Act?

The Hindu Succession Act of 1956 is a law that governs the rules of inheritance and succession among Hindus, Buddhists, Jains, and Sikhs in India. It establishes a uniform and comprehensive system for the distribution of property when a person dies without leaving a will.

  3. It abolishes the concept of a Hindu woman’s limited estate, giving her full ownership rights over her property
  4. It was amended in 2005 to further gender equality in inheritance rights

To file a case under the Hindu Succession Act, follow these steps:

  1. Identify the District Judge’s court where the deceased resided at the time of death.
  2. Draft a petition including:

   

I. Date and place of death.

II.  Details of the deceased’s properties.

III.Information about the family and heirs.

IV. Petitioner’s rights and absence of impediments.

  1. Submit the petition to the District Judge, ensuring it’s signed and verified.
  2. Attend the hearing where the judge may allow objections from other claimants.
  3. If no objections arise, the court will issue a succession certificate, granting rights to the petitioner.
