Prisoner Freed Despite Missing File
The Calcutta High Court has directed the prisoner freed despite missing documents who remained in jail until then was required for his premature release. The court acted after the authorities failed to locate the necessary file, despite earlier approval for the prisoner’s release.
Premature Release Delayed by Missing File
Justice Shampa Sarkar highlighted that the State Sentence Review Board had already recommended the prisoner’s premature release. A previous bench had ordered the Judicial Department to complete the necessary formalities. However, the file remained untraceable, causing unnecessary delays.
Court Steps in to Ensure Release which led to Prisoner Freed Despite Missing File
The authorities, represented by Additional Government Pleader Basu Mallick, admitted their inability to locate the file. They requested the court to pass orders for the prisoner’s release. The court directed correctional home authorities to release the prisoner immediately, based on the board’s earlier recommendation.
Judicial Intervention Ensures Justice
The court had earlier instructed the Judicial Department to ensure the release order reached the correctional home within two weeks. When this order was not followed, the petitioner filed a writ petition citing non-compliance.
On 28th February, the court will review the compliance and confirm the prisoner’s release order.
