My family owns a three-story building in Mumbai, with the land registered in all our names. There’s no formal division of the property. Can one of us sell their share to someone else without first dividing the property? Would it be enough if the other family members sign as witnesses on the sales deed? What documents are needed for this kind of transaction?

Under Indian law, you cannot sell your share of an undivided property without first dividing it formally. Simply having other family members witness the sale deed is insufficient. You’ll need to initiate a partition suit to divide the property and then register the sale of your individual share.
