Imagine two brothers locked in a legal battle over property in the Delhi High Court. One brother feels unfairly treated by a court decision and appeals to a larger bench. This bench, in an attempt to resolve the matter amicably, asks both brothers to reach a compromise. What happens if the brothers fail to agree and file a settlement within the given timeframe? Does it make a difference if the larger bench had already recorded their consent to settle?

If the brothers fail to reach a compromise within the given timeframe, the larger bench will proceed with the case and deliver a judgment based on the merits of the dispute. The fact that the larger bench had recorded their consent to settle does not automatically dismiss the case. The court retains the power to decide the matter if settlement efforts fail.
