If you have a grievance against a product or service that you have purchased, you can file a consumer complaint in India. Here is a general overview of the process:

  1. Contact the company: Before filing a consumer complaint, it is always advisable to first try to resolve the issue with the company’s customer service department. Contact the company’s customer service department and explain your grievance. If the company does not resolve the issue satisfactorily, you can move to the next step.
  2. Gather necessary documents: Gather all relevant documents related to your purchase, such as invoices, receipts, warranty cards, and other related documents. These documents will help to support your claim in the complaint.
  3. Identify the appropriate forum: Depending on the value of your complaint, you may need to file a complaint with the appropriate forum. Consumer complaints can be filed with the following forums:
  • District Consumer Disputes Redressal Forum: If the value of your complaint is up to Rs. 20 lakhs.
  • State Consumer Disputes Redressal Commission: If the value of your complaint is between Rs. 20 lakhs and Rs. 1 crore.
  • National Consumer Disputes Redressal Commission: If the value of your complaint is more than Rs. 1 crore.

Drafting Of Complaint

  1. Draft the complaint: Write a complaint letter stating your grievance, including all relevant facts, and enclose all supporting documents. The complaint should include details such as the date of purchase, the amount paid, the product or service description, the nature of the defect or deficiency, and the relief or compensation sought.
  2. File the complaint: File the complaint in the appropriate consumer forum by paying the prescribed fees. The complaint should be filed within the jurisdiction of the forum where the product or service was purchased, where the opposite party resides, or where the cause of action arises.
  3. Attend the hearing: Attend the hearing and present your case before the consumer forum. The forum may allow you to engage a lawyer, but it is not mandatory.

Court Decision

  1. Await the decision: After hearing both parties, the consumer forum will pass a judgement. If the judgement is in your favor, the company will be directed to compensate you for your grievance. The forum may also award costs for litigation and impose penalties on the company.

It is important to note that the process of filing a consumer complaint in India can be time-consuming, and it is advisable to seek legal advice before filing a complaint. You can also file a complaint online through the National Consumer Helpline or through the consumer court’s website. Additionally, consumer disputes can also be resolved through mediation or arbitration, which are faster and less expensive than the court process.
