How To File A Case Under The Right To Information Act
To file a case under the Right to Information (RTI) Act in India, follow these steps:
- Write a clear application on plain paper, including your name, address, and the specific information sought. You do not need to provide reasons for your request.
- Include the application fee, which is typically nominal. Payment can be made via cash, demand draft, or Indian postal order. The fee for filing a Right to Information (RTI) application in India is ₹10, as prescribed by the RTI Rules, 2012. You can pay this fee using cash, a demand draft, an Indian postal order, or online through various payment methods, including internet banking and credit/debit cards.
- Send your application to the relevant State Public Information Officer (SPIO) or Central Public Information Officer (CPIO) of the concerned public authority. Individuals below the poverty line can submit a copy of their BPL certificate to waive any fees.
- The SPIO/CPIO must respond within 30 days. If the information pertains to life or liberty, the response time is 48 hours.
- If your request is denied or not responded to, you can file an appeal with the first appellate authority. This is within 30 days of the decision.
